Terms of service

These terms apply when you use Herofab at herofab.app: the app, the API, webhooks and the try-on widget. By creating an account or buying credits you agree to them. The privacy notice explains how personal data is handled.

Accounts

You sign in with a one-time link sent to your email address. You must be at least 18 years old, and you are responsible for what happens in your account and for keeping access to your email address secure. On the Brand and Studio plans the account owner can invite team members; the owner is responsible for their use of the workspace.

Credits and plans

• Each image costs the number of credits shown next to the tool before you start. Prices and plan contents are listed on the pricing page.
• A new account receives 20 welcome credits, once per person. Welcome credits are not given to disposable email addresses or to repeated sign-ups. Images made while an account has never bought credits carry a visible herofab.app watermark.
• Plan credits renew every billing period; unused plan credits do not roll over. Credit packs do not expire and are used after the plan credits of the period.
• If a job fails, is cancelled before it finishes or does not pass Herofab's quality check, its credits are returned automatically.
• Credits have no cash value and cannot be transferred to another account.

Payments

Payments are processed by Polar (polar.sh), which acts as the merchant of record: Polar sells the plan or credit pack to you, charges applicable taxes and issues the receipt or invoice. Prices are shown in US dollars; at checkout you pay the same value in your local currency where available, and applicable taxes are added there. Subscriptions renew automatically at the end of each billing period until you cancel them. You can cancel at any time from the billing page; the plan then stays active until the end of the period you have paid for and does not renew.

Refunds

• A credit pack, or the first payment of a subscription, is refunded in full if you ask within 14 days of the purchase and none of the credits from that purchase have been used. The credits from that purchase are removed when the refund is made.
• Subscription renewals are not refunded; cancelling stops the next renewal.
• Credits for failed, cancelled or quality-rejected jobs are returned to your account automatically, as described above.
• At checkout you ask for the credits to be available immediately, which ends the statutory right of withdrawal for digital content once the service starts. This refund policy applies regardless of that consent.
• This does not limit any right you have under the consumer law of your country.

To ask for a refund, write to [email protected] from the email address of your account and include the date of the purchase.

Your images and results

• You keep all rights to the photos you upload. You give Herofab permission to store and process them, and to send them to the image-generation providers Herofab uses, only to deliver the results you ask for.
• Herofab does not claim ownership of the images it generates for you. You may use them for any lawful purpose, including commercially. Depending on the law of your country, AI-generated images may not be protected by copyright, so Herofab cannot promise exclusive rights in them.
• Herofab does not use your uploads or results to train AI models and does not sell them.
• Your uploads and results stay in your account until you delete them or your account is deleted.
• Every generated image carries IPTC "AI-generated" metadata. You are responsible for following the disclosure rules of the marketplaces and countries where you publish images, including labelling AI-generated images where required.
• Generated images show your product, but they can differ from it. Check each image before you publish it, and do not use an image that misrepresents the product you sell.

Acceptable use

You may not use Herofab to create or upload:

• sexually explicit or nude content, or any content that sexualises minors (lingerie and swimwear shown as products are allowed);
• images of a real, identifiable person without that person's permission, or images meant to deceive people about who someone is;
• products, logos, designs or photos you do not have the right to use;
• content that is illegal, hateful, violent or harassing, or that promotes illegal products;
• listings that misrepresent a product's appearance, condition or features.

You may not try to get around credit limits, the watermark or the welcome-credit rules, overload or probe the service, or resell access to it without an agreement with Herofab. Herofab may refuse a job, remove content or suspend an account that breaks these rules; where the rules allow it, Herofab tells you why.

API, webhooks and widget

API keys and webhook secrets are yours to keep confidential; requests made with your key are charged to your account. If you add the try-on widget to your store, you are responsible for how it is used there and for telling your shoppers, in your own privacy policy, that the photos they upload are processed by Herofab to produce the try-on image.

Availability and changes

Herofab relies on hosting and image-generation providers and cannot promise uninterrupted service. Tools, prices and credit costs may change; changes to prices and credit costs apply from the next purchase or billing period, and are shown on the pricing page and in the app before they apply. If these terms change in a way that affects you, Herofab will tell you by email before the change takes effect.

Liability

Herofab is provided as it is. To the extent the law allows, Herofab is not liable for indirect or consequential losses, such as lost sales or marketplace penalties, and its total liability to you is limited to the amount you paid Herofab in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for intent or gross negligence, or the mandatory rights of consumers.

Ending your account

You can ask for your data or for the deletion of your account on the account page of the app. Deletion removes your uploads, results and team access; unused credits end with the account and, apart from the refunds described above, are not paid out. Payment and accounting records are kept as the law requires. Herofab may close an account that seriously or repeatedly breaks these terms.
